The petitioners had challenged the E-Auction proceedings initiated by the YES Bank Limited in selling the property namely Techno 2 HCJ & RC, J WPs_17266 & 18748_2022 Towers situated over a parcel of land measuring Ac.3.50 cents along with the structures thereon (details whereof were given in the petitions) in exercise of the powers vested in them under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The auction has not gone through. 2. In the meantime, it appears that the rights which were otherwise vested in the YES Bank Limited have been transferred to a reconstruction company named as J.C. Flowers Asset Reconstruction Private Limited, which was incorporated in the place of YES Bank Limited. 3. As per the response filed by the YES Bank Limited, the stand taken was that it had no intention to sell the properties which were not mortgaged to the answering respondent bank. 4. Learned counsel for the petitioners in WP.No.18748 of 2022 would submit that he would be satisfied in view of the stand so taken. 5. In our opinion, the petitions even otherwise have become infructuous in view of the fact that the challenge was to the notice of auction which has since been not taken to its logical conclusion. 3 HCJ & RC, J WPs_17266 & 18748_2022 In case any action is taken by the Asset Reconstruction Company, it would be open to the petitioners to take resort to the appropriate remedies which are available in law. 6.
