DUGGIRALA SUBASH Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The' Court made the fo][owing.: ORDER: This Criminal Petition, under Sections 480 and 483 of the BharOatiya Nagarik Suraksha Sanhita, 2023, has been filed by the i--- -`` 2 petitioner/A3, seeking bail,I in crime No.01/2025 of Donkarai Police station, A.S.R.District. 2.- A case has been registered against the-petitioner and others for the offences under Sections 20(b)(ill)(C) read with 8(c) of -the Narcotic Drugs and Psychotropic Substances Act, 1985 3. Case of the prosecution, in brief, ,is{hatoh o7.01.2025 at3.00pm, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of Police,-along with staff and mediators rushed to outskirts of Donkarai Village and found the petitioner in suspicious circumstances. On seeing police, `said person tried to escape. Then police apprehended him and 6n enquiry, he disclosed his identity particulars as that of A3 and on search, police found 02 kgs of liquid ganja in his possession. The contraband along with other material was seized and_accused No.3 was arrested and remanded to judicial custody. 4. I Heard learned counsel for the petitioner and th'e learned Assistant Public Prosecutor for respondent-State. Perused the record. 5. Learned Assistant Public Prosecutor submits that except filing of' charge sheet, major part of the investigation is completed. 6. A perusal of the material available on record goes to showtha{the contraband that was allegedly seized froin the bossession of the petitioner was 02 kgs of liquid ganja and the petitioner was in judicial i= i=s= _ -- 3 custody since o7.01.2025 i.e. for more than 170 days. ]t `appears that major part of the investigation has been completed except filing of charge sheet, as R.F.S.L. report is awaiting. 7: ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein/accused No.3, on the following conditions. (i) The petitioner/A3 herein shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge, Rajamahendravaram; (ii) On release, the petitioner shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. 8. Accordingly, the Criminal Petition is allowed.
