The petitioner has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) seeking modification of the bail order dated 16.02.2024 passed in MCRC No.710 of 2024. 2. Learned counsel for the petitioner submits that vide order dated 16.02.2024, bail application filed by two applicants has been allowed by this Court directing their release on bail on furnishing a bail bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the Court. However, applicant No.2- Ashok Kumar Saha (present petitioner) was not having sufficient means to comply with the bail order of furnishing one surety in the like sum and, therefore, condition of the bail order so far as it relates to applicant No.2 Ashok Kumar Saha (present petitioner) be modified and direction be issued for his release upon furnishing personal bond in sum of Rs.25,000/- only. 3. Learned counsel for the State submits that pursuant to direction issued by this Court, he has verified the fact with respect to criminal antecedents of applicant No.2 Ashok Kumar Saha (present petitioner) at Agartala, Tripura i.e. place of his residence and as per his information, there is no other criminal antecedents of petitioner. 4. Considered the submission of learned for the petitioner in this petition and applicant No.2 in bail application. 5. The bail order of present applicant is dated 16.02.2024. This Criminal Miscellaneous Petition seeking modification of the bail order dated 16.02.2024 is filed on 29.04.2025. 6. From the aforementioned facts it is appearing that for more than one year, the applicant could not able to furnish the surety as directed by this Court for his release on bail. 7. Considering the facts of the case, I find it appropriate to allow this petition. Accordingly, direction issued for release on bail of -3- applicant No.2 Ashok Kumar Saha (present petitioner) in MCRC No.710 of 2024 i.e. “upon furnishing bail bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of Court” is modified and it is directed that “applicant No.2 Ashok Kumar Saha (present petitioner) shall be released on regular bail upon his furnishing personal bond in sum of Rs.25,000/-”. Other conditions mentioned in the bail order dated 16.02.2024 passed in MCRC No.710 of 2024 shall remain intact. 8. The petition is accordingly allowed. 9.
