The present CRMP has been filed by the petitioner with the following prayer :- “It is therefore most respectfully prayed that this Hon'ble Court may kindly be pleased to allow the petition and quash the impugned FIR against the petitioner pursuant to impugned FIR, and Subsequent Charge Sheet (P/1) bearing crime no.513/2020 for the offences punishable U/s 420, 467, 468, 471, 34 of I.P.C at P.S.- Gobra-Navapara, Dist: Raipur (CG), against the Petitioner which is pending as Cr. Cs. no.14594/2021 before the JMFC Raipur (C.G) titled as State Vs. Kishore Kumar (now Dead) & others be also be quashed, in the interest of justice accordingly.” 3. At the very outset, learned State counsel submits that the charges have been framed against the present petitioner by the trial Court on 28/11/2023 and the same charge framing order has not been challenged in the present petition and the case is fixed for recording of evidence of the prosecution witness, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer to which learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to take appropriate recourse to law as after due investigation, the charge sheet has 3 been filed before the learned trial Court and the charges have been framed against the petitioner and he wishes to challenge the charge framing order. 4. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for. 6.
