ORDER: i The Criminal Petition, under Section 482 of the Bharatiya Nagarik suraksha sanhita, 2023, is filed on behalf of the petitioner/accused No.2 to grant anticipatory bail in connection with Crime No.7/2025 of Atmakur prohibition & Excise Police Stat'lon, SPSR Nellore District. 2. A case has been registered against the Petitioner and Others for the offence punishable under Section 7 r/w 8 of the Andhra Pradesh Prohibition Act] 1995. 3. Case of the prosecution in brief, is that, on 26.01.2025, on the instructions of District Prohibition & Excise Officers, the Inspector Prohibit'lon and Excise Station, Atmakur at about 03.OOpm conducted vehicular check and found one scooter. They stopped the scooter and found two white COIour plastic bags containing total 170 liquor bottles each 180ml duty paid liquor. Then they draw three 180ml sample bottles from the above liquor bottles each brand one and put the remaining liquor bottles in the same bag, sealed and labeled and arrested A1. He confessed that he was also involved in ot-her cr.No.63/2024, dated 27.ll.2024 and seized 163 liquor bottles. Hence, the present F.IR. 4. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for respondent-State. Perused the record. +

5. Learned Assistant public Prosecutor subml.ts that investigation is going on and some more witnesses are to be examined. 6. A perusal of the material available on record goes to show that basing on the confessional statement of co-accused, the petI'tiOner hereI-n iS implicated in the present crime. There are no specific allegations against the petitioner. In view of the aforesaid facts and circumstances of the case, this court I'S inclined to consider the prayer of the petitioner for grant of an±icipatory bat-I.
7. Accordingly, in the event of his arrest with regard to this crime, petitioner/accused No.2 shall be released on bail on hI|S executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) wl'th two sureties for the II'ke Sum each tO the SatI'SfaCtiOn Of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when requI-red and that he shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioner shall appear before the station House Officer concerned, once in a week i.e. on every Sunday between 10.00 am and 05.00 pm, till filing of the charge-sheet. 8. Accordingly, the Criminal Petition is allowed.
