Petitioners, who are working as Medical Officer Level - I under the Medical and Health Services of the State, are seeking higher promotion in the category of Level - II and Level - III Medical Officer as per their seniority with the aid of relevant rules of promotion framed in that regard. It is submitted that controversy for the purposes of promotion on the basis of seniority is no more res integra in the light of judgment of this Court in the case of Dr. Sunil Kumar and others v. State of U.P. and others passed in Writ - A No.- 7438 of 2022 on 31st May, 2022. It is submitted that following the order passed in the said case a detail order came to be passed for consideration of candidature of such doctors/ medical officers who are promoted on Level - II & III in the case Vivek Kumar Pandey and others v. State of U.P. and others passed in Writ - A No.- 3613 of 2024 on 22nd March, 2024. It is submitted that petitioners' claim, therefore, are liable to be considered in the light of the orders passed by this Court. Learned Standing Counsel submits that he has no objection in the event petitioners are directed to present their claims afresh before the competent authority, namely respondent No.- 3, who may be directed to consider the respective claim of the petitioners in accordance with law. In view of the above, this petition stands disposed of with a direction to the petitioners to make their individual representation afresh within a period of four weeks from today before the respondent No.- 3 and in the event any such representations are moved as directed herein above, the respondent No.- 3 shall be dealing with each of them in the light of respective seniority and their claims under the relevant service rules and shall be passing a reasoned and speaking order within a further period of two months.
