2. Petitioner has been made accused in connection with S.T. No. 271 of 2024 arising out of Sonaraithari P.S. Case No. 40 of 2024 for the offences registered under sections 302, 201/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-I, Deoghar.
3. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 7238 of 2024 by order dated 29.10.2024.
4. On 21.04.2024, brother of the informant was run over by a truck bearing registration no. JH10BS-4748. The petitioner is said to be the driver of the said truck. It is alleged that the petitioner has deliberately run over the truck on the deceased due to the previous enmity.
6. Mr. Pran Pranany, learned counsel appearing on behalf of the petitioner, submitted that there is no eye witness to the occurrence. It was further submitted that the petitioner has been made accused only on the basis of previous enmity between the petitioner and the deceased. It was finally submitted that the petitioner is in custody for more than a year.
7. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Deoghar in connection with S.T. No. 271 of 2024 arising out of Sonaraithari P.S. Case No. 40 of 2024.
