The present transfer petition came to be filed by petitioner- Sarita Koul who figured as respondent in a petition filed by respondent herein-Rinku Koul, seeking divorce under the Jammu and Kashmir Hindu Marriage Act, 1980. 02. In terms of the petition pending before the Additional Principal Judge, Family Court Jammu, titled “Rinku Koul V/s Sarita Koul”, the petitioner herein sought transfer of the petition from Jammu Court to Principal District Judge, Kishtwar. 03. During the pendency of this transfer petition, the divorce petition of the respondent herein before the Additional Principal Judge, Family Court Jammu, is said to have Serial No. 51 2 TrP(C) No. 8/2024 suffered dismissal for non-prosecution which renders the present transfer petition/application also infructuous. 04. Learned counsel for the petitioner therefore, seeks to withdraw this transfer petition reserving right to seek revival, in the event of the divorce petition of the respondent getting restored. 05.
