THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No.33570 OF 2025 ORDER:
1. The present writ petition has been filed seeking a writ of mandamus to declare the action of Respondent No.5 in issuing the letter dated 19.11.2025 as illegal, arbitrary, unconstitutional, and violative of Articles 14, 21, and 300-A of the Constitution of India. The petitioner also seeks to set aside the said letter and requests a direction to the respondents not to disconnect the electricity service connection bearing No. 8531401005819. 2. The brief facts of the case are that, Respondent No.5 issued a notice dated 19.11.2025 to the petitioner, asking him to provide proof of ownership or possession of the premises for which electricity service connection No. 8531401005819 was granted. Upon receiving the notice, the petitioner submitted an explanation on 22.11.2025. In the explanation, he stated that the lands in Sunnipenta belong to the Irrigation Department, which had allowed villagers, including the petitioner, to construct and continue the possession by residing in their houses for several decades. 2 Considering their long-standing possession, the Irrigation Department later transferred the entire habitation area of Sunnipenta to the Gram Panchayat. The petitioner further explained that he has been in lawful possession of the property for many years. However, without considering her explanation, the respondents are attempting to disconnect her electricity connection, which is against the law and violates her right to livelihood under Article 21 of the Constitution. 3. On the other hand, the learned Standing Counsel for the respondents submitted that the petitioner's explanation dated 22.11.2025 is available with the authorities and will be examined before passing appropriate orders. It was further submitted that, if the explanation is not traceable, the petitioner may be asked to submit it again, and the authorities will consider it and pass appropriate orders. 4. Heard learned counsel for the petitioner and the learned Standing Counsel for the respondents. 5. Considering the submissions made by both the counsel and after considering the material available on record, this Court deems it appropriate to direct Respondent No.5 to examine the explanation

3 of the petitioner dated 22.11.2025 and pass appropriate orders within four weeks from the date of receipt of a copy of this order. If the explanation is not available with the authorities, Respondent No.5 may issue a fresh notice to the petitioner seeking an explanation.
Upon receiving such notice, the petitioner shall submit a detailed explanation within three weeks. Thereafter, Respondent No.5 shall consider the explanation and pass appropriate orders within four weeks. Until then, the respondents shall not take any coercive steps, including disconnection of electricity service connection No. 8531401005819 of the petitioner. 6. With the above direction, writ petition is disposed of. No costs. 7.
