Accused in Spl.C.C.No.77/2025 pending before the Court of Addl. District & Sessions Judge-FTSC-1, Bengaluru Rural District, arising out of Crime No.462/2024 registered by Attibele Police Station, Bengaluru District for the offences punishable under Sections 8 & 12 of the Protection of Children from Sexual Offences Act, 2012 is before this Court seeking regular bail.
2. Heard the learned counsel for the petitioner and
learned counsel appearing for respondent No.1.
3. Respondent No.2 who is served in the matter has remained unrepresented before this Court.
4. FIR in Crime No.462/2024 was registered by Attibele Police Station, Bengaluru District against the petitioner herein for the aforesaid offences, on the basis of first information dated 23.11.2024 received from respondent No.2 herein who is the mother of the victim girl, aged about 7 years. During the course of

investigation, petitioner was arrested on 23.12.2024 and remanded to judicial custody. Investigation in the case is complete and charge sheet has been filed against the petitioner for the aforesaid offences.
5. The bail application filed by the petitioner before the Sessions Court in Crl.Misc.No.360/2025 was dismissed on 10.03.2025. Therefore, he is before this Court.
6. Perusal of the typed first information dated 23.11.2024 submitted by respondent No.2 would go to show that, the petitioner is acquainted to first informant and allegation against him is that on 22.11.2024, he had entered the house of the first informant under the guise of giving chocolate to the victim girl, who is the daughter of the first informant and he had inappropriately touched the waist of the victim girl.
7. The petitioner aged about 52 years having no criminal antecedents is in custody from 23.12.2024. Investigation in the case is complete and charge sheet has

been filed. The maximum punishment for the alleged offences is imprisonment for a period of five years.
8. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively.
9. Accordingly, the following:
ORDER The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Spl.C.C.No.77/2025 pending before the Court of Addl. District & Sessions Judge-FTSC-1, Bengaluru Rural District, arising out of Crime No.462/2024 registered by Attibele Police Station, Bengaluru District for the offence punishable under Sections 8 & 12 of the Protection of Children from Sexual Offences Act, 2012, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees

One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
