The petitioner is before this Court seeking for the following relief: - 3 - HC-KAR NC: 2025:KHC:41362 WP No. 24979 of 2025 WHEREFORE, it is humbly prayed before this Hon'ble court, be pleased to issue the writ of Certiorari by setting aside the impugned order dated 15/07/2025 in MAG/4/SC-CR/48/2024-25 passed by the 1st Respondent i.e. Annexure-A and grant such other relief as this Hon'ble court deems fit in the interest of justice and equity. 3. Respondent No.3 had filed the proceedings under Section 23 of the Maintenance and Welfare of Parents and Seniors Act, 2007 before respondent No.2/Assistant Commissioner which came to be allowed. Challenging the same, the petitioner had filed an appeal before the Deputy Commissioner. Since the petitioner was required to approach the Deputy Commissioner in view of the order dated 25.06.2024 in W.P.No.14107/2022, respondent No.3 has only complied with the orders passed by this Court and as such, the present writ petition could not be considered on the ground that respondent No.1 did not have jurisdiction to consider the appeal. Both the counsel submit that the above matter be placed - 4 - HC-KAR NC: 2025:KHC:41362 WP No. 24979 of 2025 before the Judge who passed the order in W.P.No.14107/2022. 4. In view of the said submissions, Registry is directed to place the above petition before the Judge who had passed the order dated 25.06.2024 in WP No. 14107/2022.
