District, proposing to evict the petitioner from the land Ac. 1.05 Cts in Sy.No.568/5 of Peddapalli Village, Sidhout Mandal, Y.S.R. Kadapa District as illegal, arbitrary and in violation of Articles 14 and 21 of the Constitution of India and for a consequential direction to the respondents to assign the land Ac. 1.05 Cts in Sy. No. 568/5 of Peddapalli Village, Sidhout Mandal, Y.S.R. Kadapa District to the petitioner and pass such other order. one 2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. 3. Learned counsel for the petitioner submits that the petitioner is having land admeasuring to an extent of Ac. 1.56 cents in Sy.No.570 of Peddapalli Village of Sdhout Mandal. There is a Government land admeasuring to an extent of Ac. 1.05 cents in Sy.No.568/5, which was adjacent to the petitioner’s land. The petitioner’s family is under the occupation of the said government land, since long time. The petitioner also made an application to the respondents requesting to assign the said government land in favour of the petitioner. While things stood thus without considering the 3 application of the petitioner, the respondents issued a notice under Section 7 of the Andhra Pradesh Act No.3 of 1905, dated 05.06.2025 to the petitioner, calling for explanation. Hence, the Writ Petition. 4. Learned Government Pleader for the respondents submits that the land admeasuring to an extent of Ac. 1.05 cent in Sy.No.568/5 of Peddapalii Village is classified as government land and the said land is under the occupation of the petitioner’s family. Hence, notice under section 7 of the Act was issued to the petitioner. But the petitioner did not submit his explanation so far. If the petitioner submits explanation, the respondent authorities will consider the same and pass appropriate orders. 5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader for the respondents, this Court deems it appropriate to dispose of the Writ Petition directing the petitioner to submit an explanation along with documents if any, pursuant to the notice dated 05.06.2025, within a period of three(3) weeks from today. Further the respondents are directed to consider the application of the petitioner, if the same is pending for consideration and as per his eligibility and suitability for grant of D-Form patta, pass appropriate orders, after considering his explanation to the notice dated 05.06.2025, within a period of two(2) months thereafter. Pending disposal of the said > 4 application, the respondents are directed not to dispossess the petitioner from the subject property. 6. With the above direction, the writ petition is disposed of.
