A case has been registered against the petjtjoner and others for the offence punishable u/See.420, 406, 467, 471, 447, 427, 379,120b I/w 34 of I.p.c, section 3 of the preventI-On Of Damage to public property Act,1984. 3 case of the prosecutIOn jn brI-ef, lS that, on 15.5.2025 atabou{ oo30hrs, the complainant reported sta{I'ng that prior to 30.6.2024, at Gannavaram .i vI'IIage and Mandal, he has been workI'ng as Distr[-ct Ml-nes & Geology Officer (FAG), Krjshna Djstrjct, Machiljpatnam. Through vjgj[ance & Enforcement report and his enquiry revealed that rampant illegal mI|nl'ng/excavatI'On qctivities carrI'ed out in Bapulaapdu, Gannavaram and vI-jayawada Rural I Mandals of Krishna DI-Strict during the years 2019 to 2024 by the accused No.1 conspI'red Wlth other accused, by makl-ng fabrICatiOn Of records, uslng forged documents, fake and expI'red temporary permI'tS etc. Hence, the Present F.IR. 4' Heard learned counsel for the petl'tI-Oner and learned Asslstant pub'llc prosecutor for respondent-state. perused the record. 8/+//// a 5. Learned Assistant Public Prosecutor submits that investigation is going on and some more witnesses are to be examined. .*6. [llt is the contention of learned counsel for the petitioner/A8 that \ material allegations are leveled against accused No.1 and omnibus `accusatjons are [eve[ed against, petitioner/A8. A perusal of material on record goes to show that petitioner/A8. is alleged to be one of the associates of Al and on, his instructions, petitioner/A8 conspired with Al and other accused in committing rampant+ illegal minl'ng/ excavation u activities in Bapulapadu, Gannavaram and.Vijayawada Rural Mandals of Krishna District. The alleged incidents referred to, in the complaint relate to the years 2019 to 2024. Pr,-ma fac,-e allegations leveled as against petitioner/A8 are omnibus in nature. Furthermore, Al in the subject crime was granted anticipatory bail by this Court v,-de Order, dated 29.05.2025 in Criminal Petition No.5665 of 2025. Case of the petitioner/A8 stands on the better footing than that of A1. ln view of the aforesaid facts and circumstances, this Court is, inclined to consider the prayer of the / petitioner/A8 for grant of anticipatory bail, however, on certain conditions."* 7. Accordingly, in the event of his arrest with regard to this crime, petitioner/A8 shall be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of the arresting police officials and also on GOndi{iOn that the Petitioner Shall make himself available for I|nVeStigatiOn aS iiii- // / and when required and that he shall not cause any threat, inducement or PrOmI'Se tO the prosecution witnesses. The petitioner shall appear before the station House Officer concerned, once in a week i.e. on every sunday between 10.00 am and o5.00 pm, till filing of the charge-sheet. t8.
