PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, 2 seeking bail, in Crime No.216/2025 of Gajuwaka Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the petitioner and others for the offences under Sections 22(b) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution, in brief, is that, on 12.5.2025 at 10.00 am, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of Police, along with staff and mediators rushed to Q.No.SFA-126, Near SRMT, Autonagar, Gajuwaka and found two persons in suspicious circumstances. On seeing police, said two persons tried to escape. Then police apprehended them and on enquiry, they disclosed their identity particulars and police found 2.40 grams of MDMA (METHYLENE DIOXY METHAMPHET AMINE) drug in their possession. Police seized the contraband, arrested the accused and got them remanded to judicial custody on 12.5.2025. 4. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor representing respondent-State. Perused the record. 5. Learned Assistant Public Prosecutor submits that the contraband seized is a commercial quantity i.e. 2.40 grams of MDMA drug and investigation is at crucial stage and prays to dismiss the Criminal Petition. 6. As the quantity of MDMA Drug that has been allegedly seized from the possession of the accused is a commercial quantity and as 3 investigation is at nascent stage, this Court is not inclined to grant bail to the petitioner at this stage. 7.
