This appeal is directed against the order dated 30.06.2025 passed by the learned Additional Sessions Judge-XVI, Dhanbad in connection with A.B.P. No. 1766 of 2025 arising out of Madhuban P.S. (Dharmabandh O.P.) Case No. 01 of 2025, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.
There was a fight between two groups with respect to the marking of land on which coal was to be extracted and when the police party tried to pacify the mob, they were subjected to assault which resulted in institution of an F.I.R. against 123 persons.
It has been submitted by learned counsel for the appellant that the allegations are general and omnibus in nature and considering the said fact several co-accused persons have been granted anticipatory bail by this Court in Cr. Appeal (DB) No.447 of 2025 and Cr. Appeal (DB) No.547 of 2025. Mr. Bhola Nath Ojha, learned Spl.P.P though has opposed the prayer for anticipatory bail of the appellant, but has not disputed the aforesaid facts.
Regard being had to the above, we while setting aside the
order dated 30.06.2025 passed by the learned Additional Sessions Judge- XVI, Dhanbad in A.B.P. No. 1766 of 2025 arising out of Madhuban P.S. (Dharmabandh O.P.) Case No. 01 of 2025, direct the appellant above named to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount

each to the satisfaction of learned Additional Sessions Judge-XVI, Dhanbad in A.B.P. No. 1766 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023. This appeal stands allowed and disposed of.
