1. By the present writ petition the petitioner who is the complainant on whose complaint the proceeding under Section 40 of the C.G. Panchayat Raj Adhiniyam, 1993 has been initiated against the respondent No. 4, who is the Sarpanch of village Kotmi is specifically questioning the part of the order dated 03.10.2024, in which it has been mentioned that the proceeding under Section 40 has been closed.
2. Learned State counsel, on instructions, submits that the sentence about the closure of proceedings under Section 40 of the Adhiniyam, 1993 has been wrongly mentioned and the proceedings are still continuing against respondent No. 4 and will be concluded as per the law.
3. In view of the aforesaid submission made by the learned counsel for both the parties, the authority concerned is directed to conclude the proceedings under Section 40 of Adhiniyam, 1993, which has been initiated against respondent No. 4, pursuant to the compliant made by the petitioner, in accordance with law and on its own merits, at the earliest possible.
4. With the aforesaid observation, the petition stands disposed off. Sd/-
