JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 05.03.2025 Heard Mr. G.Bharadwaj, learned counsel for the applicant, who has filed this application under Order XXII Rule 3 of the CPC praying for substitution of the legal heirs of the appellant Deben Borkotoki who died on 24.07.2024 in the connected RSA/372/2017. Page No.# 3/3 The applicant has also preferred an interlocutory application for setting aside the abatement of the RSA /372/2017 which was allowed. The learned counsel for the applicant submits that the legal representative of late Deben Borkotoki is his wife Biku Moni Devi Borkotoki. On the death of the appellant, late Deben Borkotoky, the name of Biku Moni Devi Borkotoki, legal heir of the appellant is hereby allowed to be substituted.
