p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No. 6159 of 2025
Girija Nandini Sahoo …. Petitioner(s)
Mr. Manas Kumar Chand, Advocate
-versus- Arun Kumar Singh …. Opp. Party(s)
CORAM: JUSTICE SIBO SANKAR MISHRA
Order No.
ORDER 17.04.2026
01.
1. Heard.
2. The present writ petition under article 227 of the constitution of India has been filed by the petitioner-wife seeking a direction to the learned Judge, Family Court, Cuttack for early disposal of C.P. Case No. 284 of 2023, which is pending for adjudication. The grievance of the petitioner is that the proceeding is being adjourned from time to time without any substantial progress on account of non-filing of written statement by the opposite party-husband. Therefore, the matter is being unnecessarily prolonged.
3. It is submitted that the marriage between the petitioner and the opposite party was solemnized on 17.06.2015 under the provisions of the Special Marriage Act, 1954. Due to matrimonial discord and incompatibility, both parties have been living separately since 17.07.2017. It is further contended p. 2 that despite efforts for reconciliation by family members and well-wishers, no settlement could be arrived at and the marital relationship has irretrievably broken down, compelling the petitioner to file the aforesaid divorce petition before the Family Court, Cuttack.
4. Since the proceeding sought to be expedited at the concluding stage, it is expected that the Court below shall do well to see that the proceeding is concluded as early as possible.
5. Accordingly, the writ petition is disposed of as withdrawn with liberty to the petitioners to approach the learned Judge, Family Court, Cuttack by filing an appropriate application for early disposal of C.P. Case No. 284 of 2023. If such application is filed by the petitioner, the same shall be considered by the learned Judge, Family Court, Cuttack in accordance with law.
