Heard Mr. Sazid Kallur, learned counsel for petitioner, and Mr. K. Srinivas, learned counsel representing Mr. K. Mallikharjuna Moorthy, learned counsel for respondent.
2. This contempt case is filed alleging willful disobedience on the part of respondent in complying with the order dated 07.04.2025 passed by this Court in W.P.No.8447 of 2025.
3. The aforesaid writ petition came to be instituted questioning the inaction of respondent in considering the case of petitioner for promotion. The writ petition has been disposed of by final order dated 07.04.2025, directing 2nd respondent therein to consider the case of petitioner for promotion to the post of Deputy Executive Engineer in terms of G.O.Ms.No.257, General Administration (Ser.C) Department, dated 10.06.1999, in case he falls within the zone of
consideration, as and when DPC is constituted. Alleging that the aforesaid direction has been violated, petitioner has preferred present contempt case.
4. Respondent has filed counter inter alia stating that DPC for panel year 2025-26 is likely to be convened soon and that the name of petitioner shall be placed before the Committee as per the zone of
consideration for taking appropriate decision on the promotion of the petitioner in accordance with relevant rules and Government Orders in force.

In that view of the matter, as the direction of this Court is specific that the case of petitioner be considered as and when DPC is constituted, which is likely to happen any time soon, and as the respondent has categorically stated that the petitioner’s case would be considered in the forthcoming DPC, subject to the petitioner falling within the zone of consideration, this Court, taking cognizance of aforesaid statement, is of the opinion that the respondent has not violated the orders of this Court.
6. With the aforesaid observation, the contempt case stands closed. There shall be no order as to costs.
As a sequel, miscellaneous petitions, pending if any, shall stand closed.
