GP FOR SERVICES I The Court made the following: THE HONOURABLE SRI JUSTICE CHALLA GUNARANJAN WRIT PETITION No.14586 of 2025 ORDER: This writ petition is filed under Article 226 of Constitution of India seeking following relief: “aggrieved by the action of the impugned proceedings No.EHE02/132/2025-F SEC-CTE, dated 15.06.2025 of 3rd respondent in transferring the petitioner from Government Polytechnic Vijayawada to Government Model Residential Polytechnic Etapaka P.O. Bhadrachalam quoting as opted place though the petitioner never opted for Government Model Residential Polytechnic Etapaka P.O. Bhadrachalam nor the petitioner come under compulsory transfer as per the transfer guidelines issued by the Government in G.O.Ms.No.23, dated 15.05.2025 and G.O.Rt.No.73, dated 02.06.2025 as illegal, arbitrary, discriminatory, against the Articles 14, 16 & 21 of Constitution of India and consequently quash and set aside the impugned proceedings No.EHE02/132/2025-F SEC- CTE dated 15.06.2025 as bad under Law with a further direction to continue the petitioner in the present place Government Polytechnic Vijayawada and to pass such other orders.” 2. Heard Sri S.Harinathreddy, learned counsel for petitioner, learned Assistant Government Pleader for Services – I, appearing for 1st respondent and learned Assistant Government Pleader Technical Education, appearing for respondents 2 and 3. 2 CGR, J W.P. No.14586 of 2025 3. When the matter is taken up for hearing, learned counsel for petitioner prays this Court to give liberty to the petitioner to make a fresh representation to the respondents with a request to consider her request afresh on the ground that her husband is also in service and presently posted at Vijayawada. 4. Learned Assistant Government Pleader appearing for respondents 2 and 3 submits that, if directed, they will consider the representation to be submitted by the petitioner afresh and appropriate orders will be passed in accordance with law. 5. Recording the said submission, this writ petition is disposed of giving liberty to the petitioner to make a fresh representation to the respondents on spouse ground and on such submission of representation, 3rd respondent is directed to consider the same and appropriate orders be passed in terms of the guidelines issued by the Government vide G.O.Ms.No.23, Finance (HR.I- PLG. & POLICY) Department, dated 15.05.2025, within a period of four weeks from the date of receipt of such representation.
