This criminal revision has been filed with a prayer to allow the revision and set aside/quash the impugned judgment and order dated 16.01.2025 passed by learned Additional Principal Judge, Family Court, Court No. 3, Bareilly in Criminal Misc. Case No. 1347 (1094) of 2020 and C.N.R. No. UPBR020031292020 (Smt. Alka Shama Vs. Ambrish Shankhdhar) under Section 125 Cr.P.C., Police Station Subhash Nagar, District Bareilly and further prays to stay the effect and operation of the aforesaid order. It is submitted by learned counsel for the revisionist that in this case opposite party no. 2 is wife of the revisionist who is living separate from him without any sufficient cause and filed an application under Section 125 Cr.P.C. which was allowed by the learned trial court fixing the amount of maintenance Rs. 10,000/- per month from the date of application. Learned counsel without going into the merit of the case limits his argument to the extent of dividing the amount of arrears of maintenance in eighteen equal installments for making the payment easy. Learned A.G.A. has no objection in this case. On considering the facts and circumstances, submissions made by learned counsel for the revisionist as well as learned A.G.A. and perusal of record, the order passed by the learned trial court dated 16.01.2025, for easy payment of arrears of amount of maintenance, it will be just and proper to divide the amount of arrears of maintenance into eighteen equal installments those are to be paid month to month with the current amount of maintenance.
