The petitioners/accused challenge the registration of the First Information Report (FIR) in Crime No.48/2024 for offences punishable under Sections 3(1)(f) and 3(1)(g) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2014, and Sections 427, 506, 143, 147, 148, 149, 447, and 468 of the Indian Penal Code (IPC). 2. The 2nd respondent lodged the FIR alleging that the complainant’s grandmother, Manjulamma, had been cultivating the subject land and had filed Forms No. 50 and 53 for regularization of unauthorized cultivation. The complainant claims to be cultivating the subject land as an unauthorized occupant, and in the same survey number, Smt. Rajamma is also cultivating a portion of the land. 3. It is further alleged that, on 9.1.2023, the petitioners/accused, by forming an unlawful assembly, trespassed onto the subject land, uprooted trees using a JCB machine, and constructed a compound wall. 4. Although notice was duly served upon Respondent No.2, he chose not to appear before the Court, either in person or through counsel, and was therefore placed ex parte. - 6 - NC: 2025:KHC:12830 CRL.P No. 2799 of 2024 C/W CRL.P No. 1011 of 2024 5. The Court has heard the submissions made by the learned counsel for the petitioners and the learned High Court Government Pleader (HCGP) representing the respondent-State. 6. The alleged incident occurred on 9.12.2023, whereas the FIR was lodged only on 21.01.2024, without any plausible explanation provided for the delay. The petitioners assert ownership of the subject land, substantiated by a copy of the order passed by this Court in W.P. No.7448/2022, disposed of on 22.2.2023. In that order, a direction was issued to the concerned Tahsildar to mutate the names of the petitioners in the Record of Rights concerning the subject land. 7. Additionally, Respondent No.2 has not appeared before this Court to challenge or establish that Forms No. 50 and 53 were filed for the regularization of unauthorized cultivation. This clearly implies that the said forms were likely not submitted to the Competent Authority. 8. A perusal of the FIR indicates that there are no allegations suggesting that the petitioners abused the 2nd respondent with reference to his caste, which is a necessary element to constitute an offence under the SC/ST Prevention of Atrocities Act, 2014. - 7 - NC: 2025:KHC:12830 CRL.P No. 2799 of 2024 C/W CRL.P No. 1011 of 2024 9. The dispute between the parties appears to be purely civil in nature but has been given a criminal complexion with an ulterior motive to harass the petitioners. Permitting the investigation to proceed under these circumstances would amount to an abuse of the process of law. 10. Accordingly, the petitions are allowed. 11.
