Page 2 of 3. No.31 of 2024 at an early date preferably within a time to be stipulated by this Hon'ble Court as the petitioner is in the verge of retirement as she will retire from service on attaining the age of superannuation with effect from 30.04.2026; (B) And any other order / orders or direction / directions may be issued so as to give complete relief to the petitioner.”
4.
Learned counsel for the Petitioner at the outset contended that the present writ application has been filed at the instance of the Petitioner before the State Education Tribunal in GIA case No.31 of 2024 with a prayer for early disposal of such GIA case. Learned counsel for the Petitioner further submitted that the present Petitioner is going to superannuate from service w.e.f 30.04.2026. As such, it was contended that unless the matter is heard and
disposed of the Petitioner is likely to be seriously prejudiced.
5.
Learned counsel for the State on the other hand objected to the prayer made in the present writ application for early disposal of the GIA proceeding on the ground that several matters are pending before the Tribunal. Therefore, no specific direction can be given in the case of the present Petitioner.
6. Having regard to the submissions made by learned counsel for the Petitioner, on a careful examination of the background facts as well as the documents annexed to the writ application, further taking note of the fact that the Petitioner is going to superannuate from service w.e.f 30.04.2026, this Court deems it proper to dispose of the writ application at this stage by directing the learned Tribunal to make every endeavour to take up the case and to conclude the proceeding as expeditiously as possible preferably within a period of four months from the date of communication of a
