The petitioner has been made accused in connection with Sukhdeo Nagar P.S. Case No. 261 of 2024(N), corresponding to N.D.P.S. Case No.124 of 2024, for the offence under Sections 15 (c) & 22 of N.D.P.S. Act, pending in the court of learned Additional Judicial Commissioner-XI-cum- Special Judge (NDPS), Ranchi. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.6135/2024, by order dated 03.12.2024. On 18.05.2024 at about 09:00 A.M., Sukhdeo Nagar Police on the basis of confidential information laid ambush near Pahari Mandir, Purani Ranchi and intercepted a red color Baleno Car bearing registration No. JH- 08-F-0455. On search, 80 kgs of poppy husk was recovered from the said vehicle. Petitioner was found sitting in the said vehicle. It was submitted that petitioner is in custody since 19.05.2024. Report regarding the stage of the trial, earlier called for, has been received. It appears that out of eight charge-sheeted witnesses, two witnesses have been examined and the trial is likely to be concluded within seven months. Considering the fact that commercial quantity of poppy husk was recovered from the possession of the petitioner and the trial is already in progress, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected, at this stage. (Ambuj Nath, J.) BS/-
