Petitioner alleges violation of decision rendered in Vijay Kumar Vs. The Financial Advisor & Ors.2 whereby the respondents were directed to consider the case of the petitioner for release of retiral benefits in light of decision rendered in Nek Ram Vs. State of H.P. & Ors.3

Learned counsel for the respondents has placed on record office communication dated 31.07.2025 and on that basis

submitted that grievance of the petitioner pertaining to the arrears of the pension & recurring payment of pension has been resolved.

Learned counsel for the petitioner submitted that DCRG as also the leave encashment have not been paid to the petitioner even though he had retired months ago i.e. on 30.09.2024.
Learned counsel for the respondents submitted that DCRG and leave encashment as also any other benefits due to the petitioner on his retirement, which has not been paid to him till date, shall be paid by the respondents within three weeks from today and not later than 26.08.2025.

In view of above submissions, documents placed on record as also the assurance given by the learned counsel for the respondents of paying the admissible retiral benefits to the petitioner by 26.08.2025, the proceedings in the contempt petition are closed at this stage, with hope and trust that the respondents will abide by the assurance projected by their learned counsel. Liberty is, however, reserved to the petitioner to seek appropriate remedy, in accordance with law, at an appropriate stage, in case necessity so arises in future. Notices issued to the respondents are discharged. Pending miscellaneous application(s), if any, also stand disposed of.
