Petitioner, who is apprehending arrest in proceedings bearing File No.DRI/MZU/PuRu/ENQ-43/2024/651, File No.DRI/MZU/PuRu/ENQ-43/2024/669 and File No.DRI/MZU/PuRu/INT-108(ENQ-43)/2024 issued by the Directorate of Revenue Intelligence, Pune Regional Unit, Pune, for the offences punishable under Sections 135(1)(a) and (b) and 135 (1)(i)(A) of the Customs Act, 1962, is before this Court under Section 482 of BNSS, 2023, seeking Transit Anticipatory Bail. - 3 - NC: 2025:KHC:13091 CRL.P No. 3732 of 2025 2. Heard the learned Senior counsel for the petitioner and the learned counsel for the respondent. 3. Petitioner apprehends arrest in the aforesaid case since he has now received an Enquiry Notice from the Investigation Officer in the case. 4. Learned Senior counsel for the petitioner submits that petitioner intends to approach the jurisdictional Court at Pune and file necessary application seeking anticipatory bail. Till then, some protection requires to be given to him as he apprehends arrest in the case. 5. Per contra, learned counsel for the respondent, who has filed his statement of objections, has opposed the prayer made in the petition. 6. Undisputedly, petitioner is not arraigned as an accused in the aforesaid proceedings registered for the offences punishable under Sections 135(1)(a) and (b) and 135 (1)(i)(A) of the Customs Act, 1962. Learned Senior counsel for the petitioner has submitted before this Court that petitioner has no other criminal antecedents. The maximum punishment for - 4 - NC: 2025:KHC:13091 CRL.P No. 3732 of 2025 the alleged offences is imprisonment for a period of seven years. Petitioner intends to file necessary application before the jurisdictional Court at Pune, seeking anticipatory bail since he apprehends arrest in the present case. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of interim protection as he is apprehending arrest in the meanwhile has to be granted. Accordingly, the following order:- 7. The petition is allowed. Petitioner is granted transit anticipatory bail for a period of three weeks from the date of receipt of the certified copy of this order, so as to enable him to make necessary application before the jurisdictional Court seeking anticipatory bail in proceedings bearing File No.DRI/MZU/PuRu/ENQ-43/2024/651, File No.DRI/MZU/PuRu/ENQ-43/2024/669 and File No.DRI/ MZU/PuRu/INT-108(ENQ-43)/2024 issued by the Directorate of Revenue Intelligence, Pune Regional Unit, Pune, for the offences punishable under Sections 135(1)(a) and (b) and 135 (1)(i)(A) of the Customs Act, 1962. In the meanwhile, in the event of his arrest in the above case by respondent-Police or - 5 - NC: 2025:KHC:13091 CRL.P No. 3732 of 2025 any other Police, he shall be released, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the Investigating Officer; b) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses.
