Issue a Writ of Certiorari or any other Writ or direction against the Respondent No.2 University to quash/set aside the impugned Notification No. BMSCL/1765/2024-2025 dated 22.02.2025 (Annexure- A) b. Issue a Writ of Certiorari or any other Writ to Respondent No.1 University to allow the Respondent No.2 University to receive the payment and direct the Respondent No.2 College to schedule the Internal Assessment examinations to the petitioner. c. Grant any such relief/ reliefs as this Honourable Court may deem fit based upon the facts and circumstances of the case in the interest of justice and equity.” 2. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record. 3. The limited grievance of the petitioner that despite the Circular dated 24.03.2025 issued by the 1st respondent – - 3 - NC: 2025:KHC:12459 WP No. 7857 of 2025 University, the 2nd respondent – College is not permitting the petitioner to appear for the Internal Assessment Examination scheduled to be conducted by the respondents and as such, the petitioner is before this Court by way of the present petition. 4. In this context, it is relevant to stat that a perusal of the aforesaid Circular dated 24.03.2025 will indicate that the 1st respondent – University has permitted the petitioner to appear in the Examination and consequently, the impugned communication at Annexure-A dated 22.02.2025 issued by the 2nd respondent – College informing the petitioner that he would not be entitled to appear and take up Internal Assessment Examination deserves to be quashed and necessary directions are to be issued in this regard. 5. In the result, I pass the following:- ORDER (i) Petition is hereby allowed. (ii) The impugned communication at Annexure-A dated 22.02.2025 issued by the 2nd respondent – College is hereby quashed. - 4 - NC: 2025:KHC:12459 WP No. 7857 of 2025 (ii) In view of the Notification dated 24.03.2025 issued by the 1st respondent – University, the respondents shall permit the petitioner to appear in the Internal Assessment Examination as and when they are conducted by the respondents.
