JUSTICE MANASH RANJAN PATHAK 21/05/2025 Heard Mr. A K Talukdar, learned counsel for the petitioner and Mr. B Sarma, learned Additional Public Prosecutor, Assam. 2. Apprehending his arrest, the petitioner, namely, Raziul Islam, son of Nazrul Islam, resident of Village & P.O. Chotogoma (Erstwhile Dhubri), District-Kokrajhar, filed this application under Section 482 of BNSS, 2023, on 11.11.2024 seeking pre-arrest bail in Ratabari P.S. Case No. 157/2024 registered under Sections 420/406/379 IPC corresponding to G.R. No. 1462/2024, wherein the Court on 13.11.2024 granted him interim bail which is in force till date. 3. On instruction of the petitioner, Mr. Talukdar, learned counsel is not pressing this pre-arrest bail application, as in the meanwhile, charge-sheet in said Ratabari P.S. Case No. 157/2024 have already been filed submitting that the petitioner shall approach the appropriate Court/forum for his regular bail. 4. From the records of the case, it is seen that charge-sheet in said Ratabari P.S. Case No. 157/2024 had been filed on 31.12.2024 vide Charge-Sheet No. 181/2024 against the petitioner and six others under Sections 120(b)/420/406/379/411 of the IPC. 5. After filing of the charge-sheet in said Ratabari P.S. Case No. 157/2024 corresponding to G.R. No. 1462/2024, the same has been registered as PRC No. 349/2025 and the matter is pending before the Court of learned Additional Chief Judicial Magistrate, Sribhumi (Karimganj), wherein the learned Magistrate on 09.01.2025 took cognizance of the offences under Sections 120(b)/420/406/379/411 IPC and issued summons to the accused persons of the case. 6. As the petitioner is not pressing this pre-arrest bail application since charge-sheet in said Ratabari P.S. Case No. 157/2024 has already been filed, this pre-arrest bail application, on being withdrawn, stands closed. 7. The petitioner, Raziul Islam, son of Nazrul Islam, shall approach the Court of learned Additional Chief Judicial Magistrate, Sribhumi (Karimganj), on or before 30.05.2025 for his regular bail in said PRC No. 349/2025 arising out of Ratabari P.S. Case No. 157/2024 corresponding to G.R. No. Page No.# 3/3 1462/2024. 8. The interim bail granted to the petitioner, Raziul Islam, earlier on 13.11.2024 in said Ratabari P.S. Case No. 157/2024 corresponding to G.R. No. 1462/2024 shall remain in force only upto 30.05.2025. 9. It is also made clear that the learned Additional Chief Judicial Magistrate, Sribhumi (Karimganj), shall be at liberty to impose any such conditions, as it deems fit and proper at the time of considering the regular bail of the petitioner, Raziul Islam, son of Nazrul Islam, in said PRC No. 349/2025 arising out of Ratabari P.S. Case No. 157/2024 corresponding to G.R. No. 1462/2024 to procure his attendance during the trial of the said PRC No. 349/2025, if he is not required in any other criminal case. 10. Petitioner shall submit a certified copy of this order before the Court of learned Additional Chief Judicial Magistrate, Sribhumi (Karimganj) in said PRC No. 349/2025 arising out of Ratabari P.S.
