Jyotsna Rewal Dua, J Grievance of the petitioner raised in this writ petition was noticed as under in the order dated 01.12.2025: - “Notice. Mr. Ravinder Thakur, learned counsel, accepts service of notice on behalf of respondents No.1 and 2. Issue notice to respondent No.3, returnable for 30.12.2025, on taking steps within two days. Respondents No. 1 and 2 also to apprise respondent No.3 about pendency of the writ petition and its next date of hearing. 2. Petitioner’s grievance is to the office order dated 27.11.2025 (Annexure P-3), whereby he has been transferred from Electrical Division, HPSEBL Rajgarh to the office of Secretary, HPERC, Shimla on secondment basis vice respondent No.3. 1Whether reporters of the local papers may be allowed to see the judgment? yes 2 The transfer has been assailed on two grounds:- Firstly, petitioner could not have been sent on secondment basis to HPERC without his consent as HPERC is an independent body distinct from HPSEBL. The second ground is that the impugned transfer has been effected on the basis of an internal D.O. note. 3. Leaned counsel for the petitioner states that the petitioner has not yet joined at the transferred station. 4. In view of above, petitioner has made out a case for grant of interim order. Therefore, it is ordered that till the next date of hearing, operation of impugned office order dated 27.11.2025 (Annexure P-3) shall remain stayed. Reply be filed before the next date of hearing. List on 30.12.2025.” 2. When the matter was taken up today, learned counsel for respondents No.1 & 2–HPSEBL placed on record a communication dated 07.01.2026 conveying that two posts of Senior Executive Engineers are presently lying vacant at: (a) RE, Andhra Power House Division, Chirgaon, and (b) Electrical Division No.1, BVPCL, Jogindernagar. Learned counsel for the respondent-HPSEBL submitted that the petitioner can be accommodated at either of the above stations. 3. Learned counsel for the petitioner, on the basis of instructions imparted to her, submitted that the petitioner is ready and willing to be posted at RE, Andhra Power House Division, Chirgaon. 4. Learned counsel for the respondents–HPSEBL submits that the necessary order for posting the petitioner at RE, Andhra 3 Power House Division, Chirgaon shall be issued within five days, granting joining time to the petitioner, in accordance with law. 5. In view of above, the present petition stands disposed of. Respondents–HPSEBL shall act on the basis of the assurance given by them, as noted above.
