This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents police particularly 5th and 6th respondents in not registering the complaint of the petitioner dated 13.09.2020 and 23.09.2020 against the unofficial respondents who are illegally trespassed into the petitioner agricultural lands to an extent of Ac.1.00 cents in Sy No. 860/6 situated at Kamangaruvu area of Amalapuram Rural Mandalam and sold the mud by lifting the same from the petitioner land and the police did not register the crime and not taken action against the unofficial respondents after receipt of the complaint dated 13.09.2020 and 23.09.2020 of the petitioner is illegal, arbitrary and against the principles of natural justice and also violation of apex court rulings held in Lalitha Kumari Vs. Govt.
Govt. of UP and ors and as well as Cr.P.0 and consequently direct the respondents police to entertain the complaint and register the FIR against the unofficial respondents and punish them as per law in the interest of justice”
2. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. 3. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that based on the complaint given by the petitioner, police have registered a case in Crime No.179 of 2020 of Amalapuram Taluka Police Station, for the offences punishable under Sections 447, 427 and 506 read with 34 IPC. 3
4. Recording the submissions made by the learned Assistant Government Pleader for Home, the Writ Petition is disposed of. There shall be no order as to costs.
