The present application u/s 528B.N.S.S has been filed with a prayer to quash the order dated 05.10.2024 passed by Judicila Magistrate, Court No. 1, Aligarh in Criminal Case No. 5427 of 2022 (State v. Nishant and others) arising out of Case Crime No. 216 of 2022, under Sections 323, 504, 506 of IPC, Police Station Gabana, District - Aligarh whereby discharge application has been dismissed. After some arguments, learned counsel for the applicant does not want to press the application and wants liberty to file a appropriate application/proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
