City Civil & Sessions Judge, Bengaluru City arising out of Crime No.498/2008 registered by Hennur Police Station, Bengaluru City for the offences punishable under Sections 457, 380 & 436 of IPC is before this Court under Section 439 of Cr.P.C, seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.498/2008 was registered by Hennur Police Station, Bengaluru City against unknown person for the aforesaid offences, on the basis of first information dated 10.12.2008 received from Ms. M.D. Faizuna. Initially, a 'C' report was filed in the said case. Subsequently, the petitioner was produced under body warrant in the present case and thereafter charge sheet has been filed against the petitioner and he was arrested in the present case on 08.07.2024. His bail application - 3 - NC: 2025:KHC:14102 CRL.P No. 3796 of 2025 filed before the jurisdictional Sessions Court in S.C.No.10/2025 was rejected on 18.02.2025. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, FIR in the present case was registered against unknown person initially in the year 2008 and police had filed a 'C' report in the present case. It is only after the petitioner was arrested in Crime No.357/2014 by the very same police, he was produced under body warrant in the present case and after completion of investigation charge sheet was filed against him and in the present case, he is in custody from 08.07.2024. The case is already committed to the jurisdictional Sessions Court. 5. Learned counsel for the petitioner submits that except the aforesaid two cases, there are no other criminal antecedents against the petitioner. The alleged offences are not exclusively punishable with death or life imprisonment. Under these circumstances, I am of the - 4 - NC: 2025:KHC:14102 CRL.P No. 3796 of 2025 opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 6. Accordingly, the following: ORDER The petitioner is directed to be enlarged on bail in S.C.No.10/2025 pending on the file of the IV Addl. City Civil & Sessions Judge, Bengaluru City arising out of Crime No.498/2008 registered by Hennur Police Station, Bengaluru City for the offences punishable under Sections 457, 380 & 436 of IPC, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum (Out of which one surety shall be local surety), to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - NC: 2025:KHC:14102 CRL.P No. 3796 of 2025 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
