National Insurance Co. Ltd. vs. Sant Ram & Ors. FAO No. 446 of 2019. 23.09.2025 Present: Ms. Devyani Sharma, Sr. Advocate with Mr. Anirudh Sharma, Advocate, for the appellant. Mr. Sunil Kumar, Advocate, for respondent No.1. Mr. Sanjeev Mankotia, Advocate, for respondents No.2 and 3. CMP No. 17476 of 2025. This application has been filed by the claimant/applicant Shri Sant Ram for release of 50% of the remaining awarded amount on the ground that he has no source of income due to disability suffered by him and his son, namely, Vikesh Sharma is getting married on 26th and 27th September, 2025. Prayer has been opposed on the ground that the non-applicant/appellant has filed the appeal by contesting the quantum of compensation awarded by the learned Tribunal. It has also been submitted that the claimant has already been released 15% of the awarded amount on earlier occasion. Keeping in view the fact that the claimant requires money for the marriage of his son and also that the appeal is not likely to be finally disposed of in near future, it will be in the interest of justice, in case 20% of the remaining awarded amount along proportionate interest accrued thereon is ordered to be released in favour of the claimant/applicant. Ordered accordingly. Registry is directed to release the 20% of the balance awarded amount along with proportionate interest accrued thereon in favour of the claimant/applicant by remitting the same to his bank account, details whereof have been given in para-4 of the application, after due verification. Application stands disposed of. (Satyen Vaidya) Judge 23rd September, 2025. (Jai)
