JUSTICE MANASH RANJAN PATHAK ORDER 06.01.2025 Heard Mr. M Saikia, learned counsel for the applicant/petitioner and Mr. M Haloi, learned Special Public Prosecutor, CBI. 2) The applicant Kalpana Das, wife of Sri Bharat Das, resident of House No. 3, Page No.# 2/3 Mandakini Path, Police Station-Latasil, District-Kamrup (Metro) as petitioner preferred the connected anticipatory bail application under Section 482 BNSS, 2023 being A.B. No. 2678/2024, praying for her pre-arrest bail in Paltanbazar Police Station Case No. 288/2024 registered under Sections 316(5)/318(4)/3(5) BNS, 2023, wherein, the State of Assam was the sole opposite party, which is presently pending for adjudication. 3) The Government of Assam, in the meanwhile, handed over the investigation of the said Paltanbazar Police Station Case No. 288/2024 to the CBI and presently the investigation of the said case is carried out by the CBI. 4) Hence, the petitioner of said A.B. No. 2678/2024 has filed this application for incorporation of the CBI as party respondent No. 2 in the connected A.B. No. 2678/2024 that is pending for consideration. 5) Since the CBI is carrying out the investigation of said Paltanbazar P.S. Case No. 288/2024, after being handed over to it by the State Government; therefore the CBI is a necessary party for adjudication of said A.B. No. 2678/2024 that is preferred by the applicant as petitioner. 6) Mr. M Haloi, learned Special Public Prosecutor, CBI as well as Mr. K K Parashar, learned Additional Public Prosecutor, Assam do not have any objection in incorporating the CBI as party respondent/opposite party No. 2 in said A.B. No. 2678/2024. 7) Accordingly, this Interlocutory Application is allowed in incorporation of the CBI as party, respondent No. 2 in the connected A.B. No. 2678/2024. 8) Registry is directed to do the needful correction in the cause title of said A.B. No. 2678/2024. 9) Registry shall also reflect the name of the CBI in the cause list under the respondent column against the said A.B. No. 2678/2024. 10) List the connected A.B. No. 2678/2024 for bail hearing on 20.01.2025. 11) Petitioner shall serve a copy of the connected A.B. No. 2678/2024 to Mr. M Haloi, learned Special Public Prosecutor, CBI on or before 09.01.2025, obtaining necessary acknowledgment from him in that regard.
