The petitioner is apprehending his arrest in connection with Itkhori P.S. Case No. 57/2023, registered under sections 379/414 of the I.P.C., Section 4 and 21 of Mines and Minerals (Development & Regulation) Act, 1957, under Rule 4/54 Jharkhand Minor Minerals Concession Rule, 2004, pending in the Court of learned Additional Chief Judicial Magistrate, Chatra. 3. Learned counsel for the petitioner submits that petitioner is a driver of tractor in question and allegation is made that 100 cft sand was loaded on the said tractor. He submits that petitioner has no criminal antecedent which is disclosed in para 14 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that inspite of notice under section 35(3) of BNSS, 2023 petitioner has not complied the same. 5. In view of above, the petitioner is directed to surrender before the learned court within two weeks from the date of receipt/production of a copy of this order and the learned court will release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 6.
