Order 04/07/2025 This criminal misc. petition has been filed by the petitioner in
order to invoke inherent jurisdiction of this Court under Section 528 BNSS, wherein directions has been sought against the respondent to conduct fair and impartial investigation in respect of FIR No. 039/2025 registered at Police Station Halena, District Bharatpur for the offences under punishable under Section 420, 406, 466, 467, 471 of IPC.
Learned counsel for the petitioner would submit that although the FIR was lodged on 07.02.2025 yet even after expiry of more than four months, no substantial investigation has been
[2025:RJ-JP:24725] (2 of 2) [CRLMP-3328/2025] conducted by the appellant authorities, which is causing miscarriage of justice and serious prejudice to the petitioner. Learned Public Prosecutor has opposed the petition and has contended that investigation is being conducted strictly in accordance with law and no deliberate delay has been caused by the Investigating Officer. I have heard the rival contentions of the parties and perused the record. In the light of above, it would be in the interest of justice to direct the petitioner to submit a representation before the Investigating Officer, mentioning all the relevant facts, who shall investigate the facts along with the contents of the FIR expeditiously and shall take decision in accordance with law after completing the investigation. In view of above, the instant misc. criminal petition is
disposed of.
