(Oral) This Review Petition has been filed by the State for recalling the order dated 12.01.2023, passed by this Court in CWP No. 806 of 2022, which was filed by the writ petitioner-respondent herein.
2. The aforesaid writ petition was disposed of vide order dated 12.01.2023 by a Co-ordinate Bench of this Court, passed in a bunch of 565 cases, the lead case 1 Whether the reporters of Local Papers may be allowed to see the judgment?
2 of which was LPA No. 165 of 2021, titled as State of HP. & others VS. Surajmani & another.
3. The sum and substance of the order passed by the Co-ordinate Bench in the aforesaid bunch of cases is that the benefit of work charge status had been given to the employees from the date, they had completed eight years of service on daily wage basis.
4. It was brought to the notice of this Court during the pendency of the said bunch of cases that the State had filed an application being CMP No. 1265 of 2023, for de-linking CWP No. 806 of 2022 from the bunch of cases, on the ground that the issue as such in the said writ petition was for regularization, whereas in the bunch of cases, the issue was regarding the grant of work- charge status.
5. Counsel for the writ petitioner-respondent herein does not dispute the factual matrix.
6. Since, a large number of cases had been
disposed of by the Co-ordinate Bench of this Court by
order dated 12.01.2023 and no order had been passed in CMP No. 1265 of 2023, filed in CWP No. 806 of 2022,
3 we are of the considered view that the order dated 12.01.2023 is liable to be recalled in CWP No. 806/2002 only. Ordered accordingly. Office to make corrections in the main LPA No. 165 of 2021, also.
7. Registry is directed to list the writ petition on 23.06.2025, as per Roster.
