Criminal Appeal (DB) No. 1016 of 2025
This appeal is directed against the order dated 08.05.2025 passed in B.P. No. 319 of 2025 arising out of Bagbera P.S. Case No. 191/2023 corresponding to G.R. No. 301 of 2024 by the learned Additional Sessions Judge-III, East Singhbhum, Jamshedpur whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that in the morning of 27.12.2023 the collection agent of the company i.e., Satyendra Singh rang up the informant and intimated him about the theft of Rs.17,00,000/- kept in the almirah by some unknown persons.
Submission has been advanced by the learned counsel for the appellant that several co-accused persons have been granted bail by a Coordinate Bench of this Court in Criminal Appeal (DB) No. 666 of 2024 and Criminal Appeal (DB) No. 1538 of 2024. It has been stated that the appellant is in custody since 26.03.2025.
Learned APP though has opposed the prayer for bail of the appellant, but has not disputed the fact that the name of the appellant has surfaced on account of confessional statement of Satyendra Singh and the main accused Sikendra Kohar @ Sikendra Prajapati has been granted bail by a Coordinate Bench of this Court.
Regard being had to the above, we while setting aside the order dated 08.05.2025 passed in B.P. No. 319 of 2025 arising out of Bagbera P.S. Case No. 191/2023 corresponding to G.R. No. 301 of 2024 by the learned Additional Sessions Judge-III, East Singhbhum, Jamshedpur, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, East Singhbhum at Jamshedpur in connection with Bagbera P.S. Case No. 191/2023 corresponding to G.R. No. 301 of 2024.
This appeal is allowed.
