The petitioner has been made accused in connection with Ramkanda P.S. Case No. 37 of 2024, S.T. Case No.48 of 2025, for the offence registered under Sections 103(1) and 3(5) of the B.N.S and charge has been framed under Sections 103(1), 3(5) of BNS and Sections 3/4 of Witchcraft Act, pending in the court of Sri Prabhat Kumar Sharma, learned District & Additional Sessions Judge-II, Garhwa. Bail application of the petitioner was earlier rejected by this Court in B.A. No.1741/2025, by order dated 04.03.2025. On 22.10.2024 at about 7:30 A.M., the petitioner came to the house of the informant and started abusing his wife and daughter-in-law. She was alleging that they were practicing witchcraft. Subsequently, the husband and sons of the petitioner came there, armed with iron rod and started assaulting the wife and daughter-in-law of the Informant, due to which, daughter-in-law of the informant succumbed to her injuries. The petitioner has initiated the entire occurrence and there is allegation that she has also participated in assaulting the deceased. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is rejected.
