JUSTICE AHANTHEM BIMOL SINGH 30.04.2025 Heard Mr. N. Jotendro, learned senior counsel assisted by Md. Abdul Baqee Khan, learned counsel appearing for the petitioner and Mrs. L. Monomala, learned GA appearing for the respondents. [2] The present writ petition has been filed with a prayer for issuing a direction to the authorities to consider the case of the petitioner for his appointment to any suitable posts commensurate with his educational qualification under the Die-in-harness scheme. [3] The learned senior counsel appearing for the petitioner submitted that the present writ petition can be disposed of by issuing a direction to the respondents to consider the application submitted by the petitioner on its own merit and strictly in terms of the applicable scheme for appointment under the Die-in-harness scheme. [4] Mrs. L. Monomala, learned GA appearing for the respondents submitted that the case of the petitioner for his LAISHRA M DHAKESH ORI DEVI Digitally signed by LAISHRAM DHAKESHORI DEVI Date: 2025.05.02 12:28:52 +05'30' Page 2 appointment under the Die-in-harness scheme has already been considered by the authorities and the same has been rejected and such factum has been already communicated to the petitioner under the letter dated 05-10-2022 issued by the Additional Chief Engineer, Command Area Development Department, Manipur. [5] The learned GA submitted that if the petitioner is aggrieved by the rejection of his request for appointment under the Die-in-harness scheme as reflected in the aforesaid letter dated 05-10- 2022, the petitioner may challenge the same and that no cause survives for adjudication in the present petition unless the petitioner assail the rejection of his case for his appointment under the Die-in- harness scheme. [6] Mr. N. Jotendro, learned senior counsel submitted that the present writ petition can be closed by giving liberty to the petitioner to challenge the rejection of his case as reflected in the aforesaid letter dated 05-10-2022 and also claiming for his appointment under the Die-in-harness scheme. [7] In view of the submission made by the learned counsel appearing for the parties, the present writ petition is hereby closed as infructuous. It is made clear that the petitioner is at liberty to Page 3 challenge the rejection of his case for appointment under the Die-in- harness scheme as reflected in the said letter dated 05-10-2022 by filing appropriate writ petition.
