Mishra, A.P.P. --- Order No. 04 Dated 28th January, 2025 Heard the learned counsel for the respective sides. This appeal is directed against the order dated 29.06.2024 passed by learned Additional Sessions Judge-I, Latehar in Misc. Criminal Application No. 420 of 2024 arising out of S.T. Case No. 100 of 2024 (Balumath P.S. Case No. 183 of 2023), whereby and whereunder, the prayer for bail of the appellant has been rejected. It appears that the appellant had earlier moved for grant of bail in Criminal Appeal (DB) No. 405 of 2024 which however was dismissed at that stage vide order dated 30.04.2024. Renewing the prayer for bail of the appellant, submission has been advanced that the appellant is in custody since 26.12.2023. It has further been submitted that from the possession of the appellant a loaded pistol containing four rounds of cartridges as well as 10 other live cartridges were recovered. Mr. Manoj Kr. Mishra, learned A.P.P. has submitted that the appellant has got 11 criminal antecedents. Regard being had to the period of custody undergone by the appellant, we while setting aside the order dated 29.06.2024 passed by learned Additional Sessions Judge-I, Latehar in Misc. Criminal Application No. 420 of 2024 arising out of S.T. Case No. 100 of 2024 (Balumath P.S. Case No. 183 of 2023), direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Latehar in connection with S.T.
