The petitioner decree holder had filed Original Suit No.71 of 2003 against defendant-respondent, which was decreed on 12.01.2017. In para 2 of the supplementary affidavit it has been specifically stated that against the judgment and decree of the trial Court, no appeal or application for review or recall was preferred by the defendant-respondent and judgment and decree had become final. An Execution Case No.10 of 2017 was preferred by the decree holder for execution of the decree, which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the said Execution Case No.10 of 2017 (Jiut vs. Shichand and others). As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Civil Judge (Junior Division), Haveli, Azamgarh to decide the Execution Case No.10 of 2017 (Jiut vs. Shichand and others), in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
