1 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 3303 of 2023 Smt. Ramla Kanwar W/o. Shri Narmada Prasad Kanwar, Aged About 35 Years R/o. Respondents (Cause-title taken from Case Information System) For Petitioner : Mr. Rishi Rahul Soni, Advocate For Respondents/State : Mr. Ankur Kashyap, Dy. G.A. Hon’ble Shri Amitendra Kishore Prasad, Judge Order on Board 26.08.2025 1. The petitioner has filed this writ petition with the following relief(s):- “10.1 The Hon'ble Court may kindly be pleased to call for the entire records YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2025.08.26 18:27:37 +0530 2 pertaining to this case from possession of the respondents for it's kind perusal. 10.2 The Hon'ble Court may kindly be pleased to issue suitable writ/order/direction and quash the order dated 03.05.2023 (Annexure P/1) issued by the respondent no.3 to the extent the petitioner has been given posting at Primary School Ranpa, Gadhuproda Block Korba, District Korba (C.G.) and the respondent no.4 has been given posting at Primary School Surakachhar, Block- Katghora, District- Korba (C.G.), and 10.3 The Hon'ble Court may kindly be pleased to issue a suitable writ/order/direction commanding the respondents to grant posting to the petitioner at Primary School Surakachhar, Block Katghora, District Korba (C.G.) or at any other suitable place located nearby Surakachhar, Block Katghura, District- Korba CG.; 10.4 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner” 2. Learned counsel for the petitioner submits that the petitioner had initially assailed the order dated 03.05.2023 (Annexure P/1) passed by respondent No.3, whereby the petitioner was transferred and posted at Primary School Ranpa, Gadhuproda, Block Korba, District Korba (C.G.), while respondent No.4 was posted at Primary School Surakachhar, Block Katghora, District Korba (C.G.). The grievance of the petitioner was confined to the 3 posting at Primary School Ranpa, Gadhuproda, which according to him, was arbitrary, illegal and contrary to law. However, during the pendency of the writ petition, the petitioner has already joined at the transferred place of posting in compliance with the impugned order dated 03.05.2023. In view of this subsequent development, learned counsel for the petitioner fairly submits that the relief sought in the instant petition does not survive for consideration, and therefore, the petition has become infructuous. 3. Considering the matter in its entirety, this Court is of the opinion that once the petitioner has already joined at the transferred place of posting in pursuance of the impugned order dated 03.05.2023, no fruitful purpose would be served in keeping the present petition pending for adjudication on merits. The challenge to the impugned order has thus lost its efficacy. The grievance originally raised by the petitioner does not survive for consideration any longer, and the petition has been rendered infructuous by virtue of the subsequent event of compliance with the transfer order. 4. Accordingly, the writ petition stands dismissed as having been rendered infructuous. No order as to costs. Sd/- (Amitendra Kishore Prasad) Judge Yogesh
