Learned counsel for the petitioner and learned counsel for the State are present.
2. Learned counsel for the petitioner fairly submits that, during the pendency of the writ petition, promotion has been granted to the petitioner vide a notification issued in 2023.
Learned counsel further submits that the date of promotion mentioned in the notification is incorrect, and according to the petitioner, it should be revised.
3. Learned counsel for the State submits that the writ petition was initially filed for the grant of promotion, which has already been granted. If the petitioner is aggrieved with the date of promotion, it constitutes a fresh cause of action, and the
Patna High Court CWJC No.2886 of 2016(4) dt.08-04-2025 2/2 petitioner must file a new writ petition for that purpose.
4. In light of the above, the present writ petition is
disposed off granting liberty to the petitioner to file a representation before respondent No. 2, the Principal Secretary, General Administration Department, Government of Bihar, Patna mentioning all other legal points and reliefs, regarding the date of promotion within 30 days from today. Upon receipt of the representation, respondent No. 2, is directed to decide the matter with a reasoned and speaking order within 90 days thereafter.
