Case No. 473 of 2024, arising out of Nirsa (Kalubathan O.P.) P.S. Case No. 170 of 2024, for the offence under sections 304-B/498-A/34 of the Indian Penal Code and sections 3/4 of D.P. Act and Charge-sheet has been submitted under section 306 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-III, Dhanbad. 3. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 9493 of 2024 by order dated 30.01.2025. 4. Petitioner happens to be the husband of the deceased Bhadu Gorain who died because of asphyxia due to hanging in her matrimonial home. It appears that apart from ligature mark, deceased had sustained several mechanical injuries. 5. Learned lawyer appearing on behalf of the petitioner submitted that from the postmortem report, it will be apparent that the deceased had not sustained any mechanical injury. It was also submitted that charge has been framed under section 306/34 of the Indian Penal Code. It has been further submitted that the petitioner has remained in custody for more than a year. 6. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected Learned Trial Court shall expedite the trial.
