1. The instant petition has been filed by the petitioner under Article 226 of the Constitution of India seeking following relief:
“10.1 That, the petitioner respectfully prays for issuance of suitable writ/ direction for modifying the order dated AYUSHI SINGH Digitally signed by AYUSHI SINGH Date: 2025.08.12 17:30:22 +0530
2 24.12.2016 (Annexure-P/3) to the extent of deferment of the departmental proceeding. 10.2 That, the petitioner respectfully prays for issuance of suitable writ/ direction to decide and conclude the departmental enquiry initiated against him. 10.3 That, the petitioner respectfully prays for issuance of suitable writ/ direction to extend the benefit of promotion to the petitioner to the post of Additional District Judge (District Judge Cadre) as well as promotion to the Selection Grade District Judge at par with his juniors who have received the promotional benefits. 10.4 That, the petitioner respectfully prays for issuance of suitable writ/ direction so that, his rank be placed at the appropriate place in the Gradation List with other consequential services benefit. 10.5 Any other relief/ relief’s, which this Hon’ble Court may think fit and proper in the facts and circumstances of the case with cost of the petition, may also please be granted to the petitioner.”

At the very outset, learned counsel for the petitioner submits that departmental enquiry initiated against the petitioner has been concluded and he has been promoted to the post of Additional District Judge (District Judge Cadre). He further submits that only grievance of the petitioner left, is proper placing of petitioner in the gradation list and in this regard petitioner wants to file representation before the Competent Authority for its redressal, hence, this instant petition may be disposed of. 3.
Learned counsel appearing for respondent submits that, if petitioner files representation before the competent authority for redressal of his grievance with regard to re-fixation of his seniority then, it shall be considered and decided, in accordance with applicable law and rule. 4. In view of submission made by both the parties, the instant writ petition
3 is disposed of reserving liberty in favour of the petitioner to file representation for redresssal of his grievance as stated above. However, it is further observed that despite that, if grievance is left, petitioner may file fresh petition. SD/-
