1. Mr. Kailash Vasdev, Senior Counsel for respondent appears along with Mr. Kuldeep Kumar, Director (Residential Land), DDA, pursuant to
judgment dated 24th March 2025, whereby the Court issued a Show-Cause Notice to the officer, as to what punishment and sentence should be awarded to him, in accordance with law.
2. The reluctance and inertia of the DDA, relates to conversion from leasehold to freehold, Flat No.1, First Floor, B-9, Saket, New Delhi.
3. Initially, orders dated 31st May 2022 were passed in W.P.(C) 7412/2014 with the following directions: This is a digitally signed order. 4. Subsequent thereto, the contempt petition was filed.
5. Various contentions of the parties were assessed by the judgment of 24th March 2025 and the Court reached the conclusion that concerned official of the DDA was guilty of wilful and deliberate disobedience of the directions of this Court.
6. While, it is stated by Senior Counsel for DDA that compliance of this will have a large impact on properties in Delhi, there is no direction or protective order that they have in this regard, from any Court.
7. Accordingly, this Court does not see any impediment in ensuring compliance of orders of the Court.
8. The other issue relates to the inspection of the property for the unauthorized construction. In this regard, it is noted that these aspects have been considered in the decision of 24th March 2025, including the communication dated 29th July 2024 by the MCD to the DDA.
9. Senior Counsel for respondent, therefore, requests for two weeks’ time to ensure compliance of the orders of this Court and purge the contempt. This is a digitally signed order. 10. It is stated that an appeal has been filed against the judgment dated 24th March 2025 but the same has not yet been listed.
