CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. Gautam Kumar, Advocate For the State
: Mr. Chandan Tiwari, AC to G.A.-I
…...... 10 / 05.02.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. The candidature of the petitioner as the Swamv Sevak in Panchayat Secretariat (Sachiwalaya) in Barari Panchayat was rejected. Consequently, the petitioner was not selected. The petitioner has questioned the action of the respondents of not selecting her. 3. It is the case of the petitioner that while computing the marks during preparation of merit list, so far as other candidates are concerned, their marks in the honours subject were only considered, whereas for this petitioner, the marks for all the subjects were taken into consideration which resulted in decrease in percentage of the petitioner, thus the petitioner was not selected. He further submits that now through the counter affidavit they have come with an additional plea that the age of the petitioner was more than 35 years on the date of selection and as per the resolution, the age limit for appointment would be between 18 to 35 years. 4. I have gone through the resolution, which governs selection of
panchayat volunteers (Swamv Sevak). As per Clause-1, the minimum age limit fixed for selection is 18 years and maximum is 35 years. Be it noted that this resolution is not under challenged. It is an admitted case that on the date of selection, the age of the petitioner was more than 35 years, as her date of birth is 12.04.1979 and the date of selection is 05.07.2016. The maximum age limit as on 01.05.2016 is 35 years and on that date the age of the petitioner was more than 37 years. 5.
Considering the fact that petitioner has crossed the upper age limit, I am not inclined to grant any relief to the petitioner, accordingly, the instant writ petition stands dismissed. (ANANDA SEN, J.) R.S.
