Sharma, learned counsel appearing for the applicant, who has filed the instant application under Section 5 of the Limitation Act, for condonation of delay of 10 days in preferring an appeal against the judgment and award dated 15.06.2023, passed by the learned Commissioner, Employee’s Compensation, Nagaon in NEC No.11/2018. The learned counsel appearing for the applicant submits that the reason for the delay of 10 days in filing the appeal has been explained in paragraph 3 to 5 of his condonation application. Mr. D. Mondal, learned counsel appearing for the respondent no.1 submits that he has no objection to the condonation of delay of 10 days of filing the appeal. This court on perusal of the paragraphs 3 to 5 of the application find that the delay of 10 days is not due to any laches and negligence on the part of the applicant and accordingly find it feet fit to condone the delay of 10 days in filing the appeal against the judgment and award dated 15.06.2023. Accordingly, the Interlocutory Application stands disposed of. On the disposal of the IA, the MFA/10348/2023 is to be given a registration number and listed after 3(three) weeks.
