Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of FIR No. 63 of 2025, dated 14.5.2025, registered at Police Station Dehra, District Kangra, H.P. for the commission of offences punishable under Sections 85 and 352 read with Section 3(5) of Bhartiya Nyaya Sanhita (BNS) and consequential proceedings arising out of the said F.I.R. based on the compromise effected between the parties. 2 2025:HHC:29894
2. It has been asserted that the parties are husband and wife. The FIR was lodged due to a misunderstanding, which has been resolved with the intervention of respectable persons of the society. The parties are residing together, and the informant does not want to proceed with the matter after the compromise. 3. Statement of the victim Manu Kumari was recorded on 23.7.2025, in which she stated that she had entered into a compromise with the accused, and she had no objection in case the FIR was quashed based on the compromise. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. The offence punishable under Section 352 of BNS is compoundable under Section 359 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). Section 85 of BNS corresponds to Section 498A of IPC. Since, the parties have settled their dispute and the present petition had arisen out of the misunderstanding between them; therefore, the FIR registered for the commission of offences punishable under Section 85 read with Section 3(5) of BNS can be quashed as per the judgments in Gian Singh versus State, 2012 (10) SCC 303, Narender versus State of Punjab, 2014 (16) SCC 466, Vikas

FIR No. 63 of 2025, dated 14.5.2025, registered at Police Station Dehra, District Kangra, H.P., for the commission of offences punishable under Sections 85 and 352 read with Section 3(5) of BNS and consequential proceedings arising out of the said FIR are quashed. 7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
